Sheds, swimming pools, detached garages, and other similar construction are not permitted to encroach in a public drainage easement. Landscaping and fences are sometimes permitted in drainage easements. You must make a request to the Engineering Department and staff will determine if a fence or landscaping will be permitted to encroach into said drainage easement. Under no circumstances should a fence or landscaping cross the flow line of a ditch.
Please note: If encroachment is allowed with a fence or landscaping, the homeowner will be required to sign an Easement Agreement. This document states that the homeowner understands that if the fence or landscaping creates a problem, or if the easement has a need for work, the fence or landscaping will be removed at the homeowner's expense. This includes the removal and the replacement.
