Land Disturbance Permits (LDP)

Beginning January 1, 2005, if you are intending to disturb one acre or more of land for construction of a new building, development of a subdivision, installation of utility lines, or other non-agriculture land use, then you must obtain the City’s Land Disturbance Permit (LDP).

You are not required to obtain the Land Disturbance Permit for construction of one- and two- family dwellings. You must put Erosion Prevention and Sediment Control (EPSC) in place under terms of the residential building permit procedure and the City's Lot Level EPSC manual.

The City of Murfreesboro and its citizens desire to protect the quality of local streams. The City is also obligated to regulate storm water runoff from construction activities under state and federal water pollution control regulations.

Ordinance Establishing Post-Construction Stormwater Runoff Quality Standards

New post-construction stormwater standards have been adopted and go into full effect October 1, 2008. See more information on the Design Manuals page. The revisions focus on:

  • treatment of stormwater to reduce total suspended solids by 80%
  • applies to projects of one acre or more and construction of 10,000 square feet of impervious surface
  • includes a streambank protection – extended detention requirement for runoff generated on site
  • requires stormwater management plans, to include long-term maintenance plans

Prepare erosion prevention and sediment control EPSC) plan/SWPPP for construction activities.

Apply for the State NPDES construction general permit.

Submit to the City Engineering Dept. three copies of the EPSC/SWPPP for the project. This may be submitted prior to or with the LDP application.

 

d.

Apply for the City’s LDP, using the referenced LDP application form, and submitting three copies of EPSC plan/SWPPP.

 

e.

Attend pre-construction meeting. Contact Sam Huddleston of the Engineering Dept. or Robert Haley of MWSD for times of regularly scheduled pre-construction meetings.

 

f.

Upon approval of plans, install pre-construction EPSC at site.

 

g.

Arrange a pre-construction inspection by the city of your installed EPSC. You may do this by notifying the City’s storm water coordinator Robert Haley that pre-construction EPSC are installed.

 

h.

Upon successful installation of pre-construction site EPSC, the City will release Land Disturbance Permit. Land Disturbance Permit fee is $150 plus $50 per acre of project area.

 

LDP Requirements

Effective January 3, 2005

Permits issued by Building and Codes Department will contain the following provisions:

  1. Selection and installation of erosion prevention and sediment controls shall correspond to the EPSC/SWPPP plan approved by the City as a part of the Land Disturbance Permit application process.
  2. Installation, inspections and maintenance of EPSC shall comply with requirements set forth in Murfreesboro City Code, with respect to planning and design, as listed at City Code Chapter 27½ - 7 (d); and with respect to inspections and frequency of inspections, as listed at City Code Chapter 27½ - 5 (h).
  3. Installation and maintenance of EPSC shall be accomplished according to standard practice as described in the City-adopted “Tennessee Erosion Prevention and Sediment Control Handbook – A Guide for Protection of State Waters through the use of Best Management Practices during Land Disturbing Practices.”

LDP Fee Schedule

The fee for LDP is $150 plus $50 per acre of project area.
